David Harvey Retired Judge
The topic title is "Challenges to the Rule of Law"
This discussion will focus upon the way in which the Rule of Law is eroded especially by the institutions and individuals which should uphold it. The discussion will centre upon examples of breaches of the law that go unaddressed or alternatively the way in which State institutions make up their own rules - often contrary to law and without authority. Three examples will be discussed – where a Minister has ignored the law, where Governments Departments try to avoid their responsibilities under law and where one department ignores the law entirely and makes up its own rules.
